San Jose Municipal Codes Affecting
Cab Drivers
9.44.030 General prohibition.
Smoking is prohibited in the following places located within the city of San
José except as provided in Section 9.44.040:
A. Buildings: All enclosed areas of buildings which are open to the public
or which are places of employment.
B. Public and common areas of multifamily residential areas: All enclosed
areas of apartments, condominiums and mobilehome parks which are open to public
access or to unrestricted common access by the residents of such places.
C. Motor vehicles used in work: In motor vehicles which meet one of the following
conditions:
1. Common carriers for public transit;
2. Vehicles for hire, such as taxicabs;
3. Vehicles which are operated in the course of employment for the use of
more than one person at a time during the time of employment.
D. Hotel and motel guest rooms: The enclosed areas of at least fifty percent
of the guest rooms located in a hotel or motel. To the greatest extent feasible
the smoke free rooms shall be grouped together to each other and separated
from rooms where smoking is permitted.
E. Stadium and sports arenas: The seating and eating areas of any outdoor
stadium or sports arena. Smoking may be permitted only in specifically designated
areas which are not located in close proximity to seating or eating areas.
11.52.030 Loading zones - Demarcation.
A loading zone shall be indicated by:
A. A yellow paint line upon the top and face of the curb within the zone;
or
B. Signs at the beginning and end of the zone; or
C. Signs attached to parking meter standards at the beginning and end of the
zone.
11.52.040 Curb marking - Color to indicate no stopping and parking
regulations.
A. The city traffic engineer is hereby authorized, subject to the provisions
and the limitations of this chapter, to place, and when required herein shall
place, the following curb markings to indicate parking or standing regulations,
and said curb markings shall have the meanings as herein set forth.
1. Red shall mean no stopping, standing or parking at any time except as permitted
by the California Vehicle Code, and except that a bus may stop in a red zone
marked or signed as a bus zone.
2. Yellow shall mean no stopping, standing or parking at any time between
the hours indicated on the sign adjacent to said yellow zone, on every day
except as indicated on said sign, for any purpose other than the loading or
unloading of passengers or materials, provided that the loading or unloading
of passengers shall not consume more than five minutes, nor the loading or
unloading of materials more than twenty minutes.
3. White shall mean no stopping, standing or parking for any purpose other
than for loading or unloading of passengers or depositing mail in an adjacent
mail box and then only for not more than five minutes.
4. Green shall mean no standing or parking for longer than twelve minutes
at any time between the hours indicated on the sign adjacent to said green
zone on every day except as indicated on said sign.
5. Blue indicates that parking is reserved for the exclusive use of vehicles
used to transport physically handicapped or disabled persons. Blue shall mean
no stopping, standing or parking except for vehicles which display a distinguishing
license plate or placard issued to disabled persons pursuant to California
Vehicle Code Section 22511.5 or issued to disabled veterans as specified in
California Vehicle Code Section 9105.
B. When such zone is in front of a theater, the restrictions shall
apply at all times except when such theater is closed.
C. The city traffic engineer may determine that the above described
restrictions shall only be effective at certain times in certain zones and
shall indicate same by sign.
11.52.060 Permission to load or unload - Restrictions.
Permission granted in this chapter to stop or stand a vehicle for purposes
of loading or unloading of materials shall apply only to commercial vehicles
and shall not extend beyond the time necessary therefore, and in no event
for more than twenty minutes.
11.52.070 Loading zone - Use restrictions and time limit.
No person shall stop, stand or park a vehicle in any loading zone for any
purpose
other than loading or unloading passengers or material for such time as is
permitted in Sections 11.52.060, 11.52.080, 11.52.110 and 11.52.120.
11.52.080 Loading or unloading - Type of materials authorized.
The loading or unloading of materials shall apply only to commercial deliveries,
also the delivery or pickup of express and parcel post packages and United
States mail.
11.52.090 Passenger loading zones - Curb marking.
Passenger loading zones shall be indicated by a white line upon the top and
face of the curb within such zones, or by signs indicating such passenger
loading zones.
11.52.100 Passenger loading zones - Use restrictions and time limit.
No person shall stop, stand or park a vehicle in any passenger loading zone
for any purpose other than the loading or unloading of passengers or baggage
for such time as is specified in Sections 11.52.060, 11.52.080, 11.52.110
and 11.52.120.
11.52.110 Passenger loading zones - Baggage loading restrictions.
Permission granted in this chapter to stop or stand for purposes of loading
or
unloading passengers shall include the loading or unloading of personal baggage
when stopped in a passenger loading zone, but shall not extend beyond the
time necessary therefor and in no event for more than five minutes.
11.52.120 Loading or unloading - Enforcement of provisions.
Within the total time limits above specified, the provisions of Sections 11.52.060,
11.52.080, 11.52.110 and 11.52.120 shall be enforced so as to accommodate
necessary and reasonable loading and unloading, but without permitting abuse
of the privileges hereby granted.
25.06.350 Parking or stopping of vehicles.
A. Vehicles shall not be parked or stopped on the airport other than
in the manner indicated by posted traffic signs or other traffic markings.
B. No more than one vehicle of a ground transportation provider (other
than a provider of taxicab services) shall be stopped or parked in any loading
zone at one time without a valid waybill.
C. Each driver or other representative of a ground transportation provider
meeting a prearranged passenger or prearranged parcel pickup shall display
a copy of the waybill on any unattended vehicle in the manner prescribed by
the director.
D. Ground transportation providers shall pick up and discharge passengers
or deliver parcels, packages or baggage only at authorized locations, which
may be designated by traffic markings or signs, or rules and regulations issued
by director or by permit.
